No Attorney-Client Relationship

By submitting your information through our Services, you acknowledge that no attorney-client relationship is formed with Transport Digital Media LLC d/b/a Tort Defenders. An attorney-client relationship, if any, is formed only with the third-party licensed attorney to whom your case is referred, and only upon the acceptance of the case by that attorney and execution of a separate engagement agreement.

No Legal Representation

Transport Digital Media LLC d/b/a Tort Defenders does not provide legal representation. We are an intake and referral service. All legal representation is provided by third-party licensed attorneys. Your legal rights and obligations are determined solely by the third-party attorney's engagement agreement and applicable law.

Cases Referred to Third-Party Attorneys

All cases submitted through our Services are referred to third-party licensed attorneys. These attorneys are independent and not employees or agents of Transport Digital Media LLC d/b/a Tort Defenders. We make no representations regarding the qualifications, competence, or fitness of any third-party attorney. Your legal outcomes depend solely on the third-party attorney's representation, skill, and diligence.

Non-Endorsement

Transport Digital Media LLC d/b/a Tort Defenders does not endorse, recommend, or guarantee the quality, fitness, or competence of any third-party attorney. You are solely responsible for evaluating any attorney to whom your case is referred.

Our Website may contain information, content, links, and references to third-party websites, services, and resources. We do not endorse, verify, or assume responsibility for any third-party content or services. Your use of third-party websites and services is at your own risk and is governed by the terms and conditions of those third parties.

We are not responsible for:

Once your case is referred to a third-party attorney, your interactions, communications, legal representation, and any legal outcomes are the sole responsibility of that third-party attorney. Transport Digital Media LLC d/b/a Tort Defenders shall not be liable for:

• The conduct, competence, or diligence of any third-party attorney;      
• Any legal advice provided by third-party attorneys;          
• The outcomes of any legal matter;      
• Breach of fiduciary duty by third-party attorneys;          
• Failure to represent your interests adequately;
• Any communications or interactions with third-party attorneys.

Any disputes with third-party attorneys must be resolved directly with those attorneys or through appropriate legal or regulatory channels, not with Transport Digital Media LLC d/b/a Tort Defenders.

By using our Services, you represent and warrant that:

• You are at least 18 years of age; 
• All information you provide is accurate, truthful, and complete;        
• You have the authority to submit your case and information;      
• Your use of the Services complies with all applicable laws;       
• You will not use the Services for illegal, fraudulent, or harmful purposes;         
• You understand that no attorney-client relationship exists with Tort Defenders.

You agree to indemnify, defend, and hold harmless Transport Digital Media LLC d/b/a Tort Defenders, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Services; 
• Your breach of these Terms;

• Your submission of false, inaccurate, or fraudulent information;        
• Your interactions with third-party attorneys;          
• Any claims arising from your case or legal matter.

All content, materials, designs, logos, text, and software on our Website are the exclusive property of Transport Digital Media LLC d/b/a Tort Defenders or its licensors. No part of the Website or Services may be reproduced, distributed, or transmitted without our express written consent. All intellectual property rights are reserved.

Transport Digital Media LLC d/b/a Tort Defenders grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services solely for the purpose of submitting your legal case for intake and referral. This license does not include the right to:

• Reverse-engineer or decompile any software;      
• Remove any proprietary notices or labels;

Governing Law

These Terms and your use of the Services shall be governed by and construed in accordance with the laws of Delaware, without regard to its conflict of laws principles. All disputes, claims, and causes of action arising out of or related to these Terms or the Services shall be brought exclusively in the state and federal courts located in New Castle, Delaware.

Class Action Waiver

YOU AGREE THAT ANY DISPUTE OR CLAIM SHALL BE BROUGHT SOLELY IN YOUR INDIVIDUAL CAPACITY, AND NOT AS A CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE ACTION. You waive any right to participate in a class action, class arbitration, or similar proceeding against Transport Digital Media LLC d/b/a Tort Defenders.

Arbitration

No Third-Party Beneficiaries

By submitting information through our Services, you consent to receive communications regarding your legal case intake and referral. You further consent to the following communication channels and programs:

4.A Service SMS Messages

By providing your mobile phone number, you consent to receive Service SMS messages from "Tort Defenders (Transport Digital Media LLC)" and/or third-party attorneys assigned to your case. These messages may include:

• Case status updates and notifications;
• Attorney assignment confirmations;
• Legal intake follow-ups;   
• Appointment reminders;     
• Important case-related information.

4.B Marketing SMS Messages

In addition to Service SMS messages, you may elect to receive optional Marketing SMS messages from Tort Defenders regarding new services, promotions, case types, and general information. This consent is separate and optional. Carriers are not liable for delayed or undelivered messages.

4.C Voice AI and Automated Telephone Dialing System (ATDS) Consent

By providing your phone number, you understand and consent to receive calls using automated telephone dialing systems, artificial intelligence voice technology, and pre-recorded messages from Tort Defenders, Transport Digital Media LLC, and/or third-party attorneys assigned to your case. These calls may be made to your mobile or landline telephone number.

4.D Email Communications

We may contact you via email at the address you provide for:

• Service Emails: Case updates, attorney assignments, intake confirmations, and legal matter information;      
• Marketing Emails: Promotional content, new services, and general information (optional).
